Earn $1,000 for every company you send our way

The Program rewards eligible Referrers who introduce new prospective clients to HireHawk and whose referrals result in a successful HireHawk placement. The Program is intended for genuine business referrals and introductions.

Except for current employees of HireHawk, any individual or organization legally able to participate may submit a referral, subject to these Terms. Current HireHawk employees are not eligible to receive referral rewards under the Program. Contractors, former employees, existing or former clients, vendors, agencies, and other third parties may participate, subject to these Terms. A person or organization that has a separate written referral, affiliate, commission, partnership, or similar agreement with HireHawk will be governed by that separate agreement for referrals covered by it.

A referral must be submitted through HireHawk's designated referral process or otherwise acknowledged by HireHawk in writing. Referrers must provide accurate information and must have permission or another lawful basis to share a prospective client's contact information with HireHawk.

A "Qualified Referral" is a prospective client that, at the time the referral is received by HireHawk:

• is a prospective client based in the United States or Canada;
• is not an active HireHawk client;
• is not already recorded by HireHawk as an active sales opportunity or otherwise in an active sales process;
• has been identified with sufficient information for HireHawk to reasonably verify and contact the prospective client; and
• was referred before the prospective client entered into an agreement for HireHawk services.

If more than one person refers the same prospective client, the referral first received and accepted by HireHawk will qualify, based on HireHawk's records. HireHawk may contact the Referrer if additional information is needed to verify a referral.

For each Qualified Referral that becomes a HireHawk client, the Referrer will earn a one-time referral reward of USD $1,000 when at least one resource placed or managed through HireHawk for that client completes 30 consecutive calendar days of active engagement with the referred client (a "Successful Referral").

The 30-day requirement is not satisfied if no HireHawk resource completes 30 consecutive calendar days with the referred client. If an initial resource leaves or is replaced before completing 30 consecutive calendar days, the referral may still become a Successful Referral when a subsequent HireHawk resource completes the required 30 consecutive calendar days.

Only one USD $1,000 reward is payable per referred client, regardless of how many resources the referred client hires or engages through HireHawk.

A referral reward is not conditioned on the referred client's payment status. Once the 30-day active-engagement requirement has been satisfied and HireHawk has verified the Successful Referral, the reward is earned subject to these Terms.

HireHawk will issue an earned referral reward within 30 days after verifying that the Successful Referral requirements have been met and after receiving any identity, tax, banking, or other payment-processing information reasonably required to process the reward.

Referrers must act lawfully and honestly when discussing or promoting HireHawk. Referrers may not:

• make false, misleading, or unsubstantiated statements about HireHawk, its services, pricing, candidates, results, or guarantees;
• represent that they are an employee, agent, legal representative, or authorized spokesperson of HireHawk;
• bind HireHawk to any agreement, price, promise, obligation, or commitment;
• use deceptive, fraudulent, abusive, or unlawful referral methods; or
• send unsolicited marketing communications or otherwise promote HireHawk in violation of applicable law.

If a Referrer publicly promotes, recommends, or endorses HireHawk in connection with the Program, the Referrer must clearly disclose, when required by applicable law, that the Referrer may receive a financial reward for successful referrals.

Referral rewards may be taxable. The Referrer is responsible for all taxes, duties, reporting obligations, and other liabilities arising from a reward. HireHawk may require the Referrer to provide a completed Form W-9, Form W-8BEN, Form W-8BEN-E, or other applicable tax or payment documentation, and HireHawk may report or withhold amounts as required by law.

Participation in the Program does not create an employment, agency, franchise, joint venture, fiduciary, partnership, or other similar relationship between HireHawk and the Referrer. The Referrer has no authority to act for or bind HireHawk.

A Referrer may accurately identify HireHawk by name solely for the purpose of making a referral. No other license or right to HireHawk's trademarks, logos, copyrighted materials, website content, or other intellectual property is granted. Use of HireHawk logos, branded creative, or other protected materials requires prior written approval from HireHawk and must stop upon HireHawk's request.

HireHawk may reject or disqualify a referral, withhold an unpaid reward, or remove a Referrer from the Program if HireHawk reasonably determines that the referral or participation involves fraud, manipulation, duplicate or fabricated information, a violation of these Terms, unlawful conduct, or an attempt to improperly obtain a reward. Self-referrals and referrals created solely to generate a reward are not eligible.

HireHawk may modify, suspend, or terminate the Program or these Terms at any time. Unless required by law or necessary to address fraud or abuse, a change will not reduce a reward already earned before the effective date of the change. Referrals submitted before a change may remain subject to the version of the Terms in effect when the referral was received, as reasonably determined by HireHawk.

To the maximum extent permitted by law, HireHawk will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising out of or relating to the Program. To the maximum extent permitted by law, HireHawk's aggregate liability to a Referrer arising from the Program will not exceed the amount of any referral reward that HireHawk has determined is earned and unpaid to that Referrer.

These Terms will be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-laws principles. Any legal action or proceeding arising out of or relating to these Terms or the Program will be brought exclusively in the state or federal courts located in Austin, Texas, and each party consents to the personal jurisdiction and venue of those courts.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. HireHawk's failure to enforce a provision is not a waiver of that provision. A Referrer may not assign or transfer Program rights without HireHawk's written consent. These Terms, together with any written referral-specific confirmation from HireHawk, constitute the agreement between HireHawk and the Referrer regarding the Program, except where a separate written agreement applies.

"Referrer" means the individual or organization submitting a referral under the Program.

"Qualified Referral" has the meaning stated in Section 3.

"Successful Referral" has the meaning stated in Section 4.

"Referred Client" means the prospective client identified in a Qualified Referral that enters into an agreement for HireHawk services.

By participating in the HireHawk Referral Program, you acknowledge that you have read and agree to these Terms.
